ColourDeck ("we," "our," or "us") is committed to protecting the privacy of our users ("you" or "Customer"). This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you visit our website, use the ColourDeck web application, and interact with our services (collectively, the "Service").

We adhere to the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth).

1. Information We Collect

We collect personal information necessary to provide, maintain, and improve our software platform.

  • Account & Identity Information: When you create an account or start a trial, we collect your name, email address, practice/business name, role/title, and login credentials.
  • Billing & Transaction Data: Subscription transactions are processed via our payment processor (Stripe). We do not store full credit card numbers or sensitive CVVs on our servers. We receive and store transaction metadata, including billing name, billing address, email address, the last four digits of your card, expiration date, and transaction receipts.
  • Workspace & Project Content: We store the project data you create within ColourDeck, including custom palettes (or "decks").
  • Usage & Technical Diagnostics: We collect standard operational metadata when you interact with the Service, such as IP addresses, browser types, device information, operating systems, referring URLs, session timestamps, and page interaction metrics.
  • Communications: Records of correspondence, bug reports, and feedback submitted via support forms or email.

2. How We Collect Personal Information

We collect personal information directly from you when you:

  • Register for an account or free trial;
  • Subscribe to a paid plan;
  • Create, save, or export design palettes and project specs;
  • Contact customer support or submit product feedback;
  • Receive an invitation from a team administrator on a Studio plan.

We also collect technical data automatically through cookies, local storage, and server log files as you navigate the platform.

3. How We Use Your Information

We use your personal information solely for legitimate business and operational purposes, including to:

  • Provide, authenticate, and maintain your access to the Service;
  • Process subscription payments, renewals, and generate tax invoices;
  • Store, sync, and retrieve your project palettes and compliance calculations;
  • Communicate operational updates, service alerts, and essential billing notices;
  • Respond to your technical support requests and missing paint code submissions;
  • Monitor platform stability, prevent fraudulent trial cycling, and protect system security;
  • Fulfill legal, tax, and regulatory compliance obligations in Australia.

We do not sell, rent, or trade your personal information or your private project palette data to third parties or paint manufacturers.

4. Disclosure of Personal Information

We only disclose your personal information to third-party service providers who assist us in operating our business under strict confidentiality agreements, including:

  • Payment Gateways: Third-party payment processors (such as Stripe) to securely handle transactions and billing portals.
  • Cloud Infrastructure & Hosting: Secure cloud hosting, database providers, and server infrastructure located in secure facilities.
  • Transactional Email & Communication Services: Providers used to deliver magic login links, password resets, and subscription receipts.
  • Analytics & Performance Monitoring: Services used to identify bugs, monitor uptime, and understand platform usage patterns.
  • Legal Requirements: When required by law, subpoena, court order, or governmental authority to comply with applicable Australian laws.

5. Cross-Border Data Storage & Transfers

Our primary cloud infrastructure and database servers are located in Australia and hosted via Amazon Web Services (AWS). All core project data and account information is stored domestically.

However, we may use specialized third-party SaaS vendors (such as payment processors for billing) who may store or process specific operational data on servers located outside of Australia.

By using the Service, you consent to the transfer and storage of such specific information with these reputable infrastructure providers, subject to standard industry security measures.

6. Data Security & Retention

  • Security Safeguards: We implement commercially reasonable technical and administrative security measures to protect your information against unauthorized access, loss, misuse, alteration, or disclosure. All web traffic is encrypted in transit using standard Transport Layer Security (TLS/HTTPS), and passwords/credentials are cryptographically hashed.
  • Data Retention: We retain your account and project information for as long as your account remains active or as required to fulfill legal, accounting, or dispute-resolution requirements. If you cancel your subscription or request account deletion, we will delete or anonymize your personal information from active databases within a reasonable timeframe, subject to routine backup lifecycles.

7. Your Rights & Access to Your Information

Under the Australian Privacy Principles, you have the right to:

  • Access: Request access to the personal information we hold about you.
  • Correction: Request corrections to any inaccurate, incomplete, or outdated personal information.
  • Account Deletion: Request the deletion of your account and associated private project data.

8. Cookies and Tracking

ColourDeck uses essential session cookies and local storage tokens to maintain your logged-in state and interface preferences. We do not use intrusive cross-site ad tracking networks. You may disable cookies in your browser settings, though doing so will prevent you from logging into your workspace.

9. Changes to This Privacy Policy

We may update this Privacy Policy periodically to reflect enhancements to our features, infrastructure changes, or legal obligations. We will notify you of material changes by posting an updated version on our website with a revised "Last Updated" date and, where appropriate, via email notification.
